Newton County Prosecutor's Infraction Deferral Agreement

INFRACTION DEFERRAL AGREEMENT
Comes now the State of Indiana by its Deputy Prosecuting Attorney and comes now the Defendant agree, pursuant to I.C. 34-28-5-1 and hereby agree and stipulate to the following:
1.That the Defendant herein is charged with an Infraction.
2.That the Defendant affirms that he/she does not possess a Commercial Driver's License (CDL).
3.That the Defendant shall report, if and when, as directed by the Prosecuting Attorney.
4.That the Defendant herein agrees to pay to the Clerk of the Newton Superior Court the total of $192.50, due on the same date as entering the Infraction Deferral Program.
5. That the Defendant not violate any State laws, including traffic violations, during the term of this agreement.
6. That the Defendant must answer all reasonable inquiries by the Prosecuting Attorney.
7. If, in the sole discretion of the Prosecuting Attorney, the Defendant faithfully and fully complies with all of the above terms and conditions, this charge (if filed) will be dismissed six months after the execution of this agreement.
8. That the Defendant understands that what he/she is signing is a legal agreement and failure to meet any of the specified terms in said agreement, including the timely payment of the $192.50 fee, will result in the Prosecuting Attorney reinstating the initial charge.
